Mr. Benson counsels and represents government contractors, subcontractors, and design professionals on a range of issues, including contract formation, preparation of certified claims, quantification of damages, delay issues, terminations for convenience and default, Miller Act bond and pass-through claims, internal investigations, compliance with the Federal Acquisition Regulation, and False Claims Act issues.

He also defends against improper contractor performance evaluations (CPARS) by drafting rebuttal contractor comments, negotiating with agencies for withdrawal, and bringing CDA claims where necessary. His arguments on behalf of contractors have been adopted by the U.S. Court of Federal Claims, and cited as authority by other federal courts.

While Mr. Benson’s primary focus is on the resolution of disputes through negotiation, he has successfully represented clients in a variety of forums including federal and state courts, before the boards of contract appeals, and in arbitrations and mediations. He maximizes recovery of contractors’ costs, to include recovery of consultant’s and attorney’s fees.
